Cimmarusti Law Secures Victory in Fraud Action

Cimmarusti Law obtained a court order sustaining Brink’s employee Gloria Corrales’ demurrer to Plaintiffs’ claims for fraud, concealment, misrepresentation and negligence in the Los Angeles Superior Court action Theresa Chang v. Brinks Global Services USA, Inc., et al., Case No. 22STCV27209.  Plaintiffs alleged over $100 million in damages resulting from the theft of merchandise after a jewelry trade show in Northern California.  Ms. Corrales argued she had no duty to Plaintiffs based on the economic loss rule and applicable case law that bars a party from alleging they justifiably relied on representations that are contradicted by the governing contract at issue.  The court agreed, dismissing the lawsuit and awarding Ms. Corrales approximately $34,000 in costs.
